
The Nigerian government is set to arraign former Kaduna State governor, , at the Federal High Court in Abuja over claims that he illegally intercepted phone communications of former National Security Adviser, .
Court filings dated February 16, 2026, reveal three counts against El-Rufai:
- Admitting on Arise TV that he and associates unlawfully intercepted NSA communications, violating Section 12(1) of the Cybercrimes (Prohibition, Prevention, etc) Amendment Act, 2024.
- Associating with individuals involved in the interception without reporting them, contrary to Section 27(b) of the same Act.
- Using technical systems to compromise national security, in breach of Section 131(2) of the Nigerian Communications Act 2003.
The charges were filed by DSS legal team members: M.E. Ernest, O.M. Owan, U.M. Bulla, C.S. Eze, and E.G. Orubor.
The case is expected to be heard in the coming days, marking a high-profile legal showdown over allegations of cybercrime and threats to national security in Nigeria.
